KaziDay Terms of Use

Welcome to the KaziDay website, accessible at https://postiz.kaziday.com/ (hereinafter the "Site"). By accessing or using the Site, you agree to comply with and be bound by these terms and conditions (hereinafter the "Terms of Use").

1. Newsletter Subscription

You have the option to subscribe to our newsletter to receive information about our products and promotions. By subscribing, you consent to receive marketing communications from us via email. You may unsubscribe at any time by clicking the "unsubscribe" link in each email.

2. Payment

If you subscribe to a paid service via KaziDay, you agree to pay the applicable fees as indicated during the payment process. Unless otherwise required by law, all payments are final and non-refundable. We may use a third-party payment processor to handle your payment; in such cases, your payment information will be subject to that processor's privacy policy. KaziDay reserves the right, at its sole discretion, to make promotional offers with different features and pricing, which will not apply to your offer or these Terms unless specifically made to you. Furthermore, third-party payment service providers may charge additional fees. KaziDay does not store any credit card information on its servers but may retain a secure payment token if you choose to save it to your profile.

3. Use of Cookies and Similar Technologies

We use cookies and similar technologies to track your use of the Site and for marketing purposes. By using the Site, you consent to our use of cookies in accordance with our Privacy Policy. Cookies are small data files stored on your hard drive or in your device's memory. Web beacons (or pixel tags) are electronic images that may be used in our services or emails to help deliver cookies, count visits, and understand usage and campaign effectiveness. Most web browsers are set to accept cookies by default, but you can usually change your browser settings to refuse or remove them, which could, however, affect the availability and functionality of our services.

4. Age Requirement

The Site and services are not intended for individuals under the age of 18 (or the age of legal majority in your jurisdiction). By using the Site, you represent and warrant that you are of legal age to form a binding contract with KaziDay.

5. User Conduct and Acceptable Use

  • Post, upload, or distribute any content that is unlawful, defamatory, harassing, abusive, fraudulent, obscene, or otherwise objectionable.

  • Violate the intellectual property or other rights of third parties.

  • Impersonate any other person or entity.

  • Upload or transmit viruses, malware, or any other code designed to disrupt, damage, or limit the functionality of any computer software or hardware.

  • Engage in spamming, phishing, or other unauthorized solicitations.

  • Attempt to gain unauthorized access to our computer systems or engage in any activity that disrupts, diminishes the quality of, interferes with the performance of, or impairs the functionality of the Service.

6. Intellectual Property

  • Postiz Application Content (Underlying Software): The source code of the Postiz application is open-source. The intellectual property rights to this code belong to its original developers and contributors. Its use is governed by its specific open-source license.

  • KaziDay Site Content: All content that you (as the operator of KaziDay) create and add to your self-hosted implementation, including text, graphics, logos, images, and videos, is your property or the property of your licensors and is protected by intellectual property laws. You may not reproduce, modify, distribute, or otherwise use this content without our prior written consent.

  • User Content: Certain features of the service allow users to submit content, such as social media posts, messages, reviews, photos, and other materials (collectively, "User Content"). You retain ownership of your User Content. However, by submitting it to KaziDay, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, distribute, display, and perform your User Content in connection with providing the service. You are solely responsible for your User Content and warrant that you are the creator and owner of it, or that you have the necessary licenses and permissions to grant us this license, and that your User Content does not violate any third-party rights (including intellectual property and privacy rights).

7. Disclaimer of Warranties

The information and content on the Site are provided for informational purposes only and are not intended to be a substitute for professional advice. We make no representations or warranties of any kind, express or implied, regarding the accuracy, reliability, completeness, or suitability of the information and content on the Site. You use the Site and its content at your own risk. The service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind. KaziDay does not warrant that the Site is accurate, complete, reliable, current, or error-free, nor that it is free of viruses or other harmful components.

8. Limitation of Liability

In no event shall KaziDay (as the operator) be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site, its content (including User Content), or your newsletter subscription, whether such liability is based on contract, tort, negligence, or any other legal theory. Our total liability to you for any claim related to the Site shall not exceed the total amount you have paid for the use of the service (if any). The limitations set forth in this section shall not apply in cases of gross negligence, fraud, or willful misconduct by KaziDay.

9. Account Suspension and Termination

We reserve the right to suspend or terminate your access to the Site at any time, without notice and at our sole discretion, for any conduct that we believe violates these Terms of Use or is harmful to other users of the Site, us, or third parties, or for any other reason.

10. Changes to the Terms of Use

We reserve the right to update or modify these Terms of Use at any time. Any changes will become effective upon their posting on the Site. Your continued use of the Site after such changes constitutes your acceptance of the revised Terms of Use.

11. Indemnification

You agree to indemnify and hold harmless KaziDay (your entity), its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your User Content, your violation of these Terms of Use, or your violation of any third-party rights.

12. Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the jurisdiction where KaziDay (the operator) is established. However, KaziDay endeavors to respect the rights and protections afforded by the applicable laws in the user's country of residence (e.g., EU laws for European residents and U.S. federal and state laws for U.S. residents), particularly concerning data protection and consumer rights. Any dispute arising from these Terms of Use shall be subject to the exclusive jurisdiction of the competent courts in the location where KaziDay is based, unless mandatory local law in the user's country requires another jurisdiction.

  • Note on Jurisdiction: As previously mentioned, this approach is complex. It is strongly recommended to consult an attorney to validate its legal feasibility and wording.

13. Entire Agreement

These Terms of Use constitute the entire agreement between you and KaziDay regarding the use of the Site and supersede all prior or contemporaneous agreements, oral or written, on the same subject matter.

14. Severability

If any provision of these Terms of Use is found to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

15. Waiver

The failure of KaziDay to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision.

16. Feedback and Suggestions

If you choose to provide us with feedback, ideas, or suggestions regarding the Site or services ("Feedback"), you agree that we are free to use such Feedback in any way we see fit, without any obligation of compensation or credit to you.

18. Third-Party Services and Terms

Our primary goal is to enable you to publish your content to the social networks you have authenticated with. We allow you to link your KaziDay account with third-party platforms, such as YouTube or GitHub.

  • Once you connect your content to a social media platform, its use is also governed by that platform's terms of service.

  • For example, if you connect your YouTube account, you agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms).

  • To revoke KaziDay's access to your data via the YouTube API Services, you can visit the Google security settings page: https://security.google.com/settings/security.

  • Similarly, if you connect with a third-party service like GitHub, we will have access to certain information from that service in accordance with the authorization procedures determined by it.
