DAPPER DUDES LLC provides a customer engagement and notification platform that enables businesses to send and receive compliant SMS and MMS messages. Our Services are designed for legitimate business communications, including personalized messages, appointment reminders, notifications, and two-way customer interactions.

All Services are provided subject to full compliance with applicable laws, including the Telephone Consumer Protection Act (TCPA), 10DLC regulations, and carrier guidelines.

2. Eligibility and Account Registration

You must be at least 18 years old and capable of forming a binding contract to use our Services. Businesses using our platform must ensure all communications comply with relevant laws and obtain proper consent from message recipients.

3. Compliance Obligations

You agree to:

  • Obtain and maintain valid prior express written consent from all message recipients as required by TCPA and other laws.

  • Register all messaging campaigns under 10DLC or other applicable frameworks.

  • Honor all opt-out requests immediately.

  • Not use the Services for any unlawful, harassing, spam, or fraudulent purposes.

  • Comply with all applicable federal, state, and carrier regulations.

We reserve the right to suspend or terminate Services immediately if we reasonably believe there is a violation of these obligations.

4. Prohibited Uses

You may not use the Services to:

  • Transmit unsolicited messages or spam.

  • Engage in any activity that violates TCPA, CAN-SPAM, or similar laws.

  • Send messages containing illegal, defamatory, obscene, or harmful content.

  • Impersonate any person or entity.

  • Interfere with the operation of our platform.

5. Intellectual Property

All content, trademarks, logos, and technology related to the Services are the exclusive property of DAPPER DUDES LLC. You are granted a limited, non-exclusive, non-transferable license to use the Services during the term of your agreement with us.

6. Fees and Payment

You agree to pay all applicable fees for the Services as outlined in your account or service agreement. Failure to pay may result in suspension of Services.

7. Disclaimer of Warranties

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

To the fullest extent permitted by law, DAPPER DUDES LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

Our total liability shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.
