The law of war rests on five fundamental principles that are inherent to all targeting decisions: <ol><li>- military necessity,</li><li>- unnecessary suffering,&nbsp;</li><li>- proportionality,</li><li>- distinction (discrimination),</li><li>- and honor (chivalry).&nbsp;&nbsp;&nbsp;</li></ol><ol><li>Military Necessity. Is this action (e.g., attack) permitted under applicable international law and required to quickly and efficiently defeat the enemy? A separate, but intimately related, question is whether the target of the attack is a valid military objective. The meaning of&nbsp;&nbsp;&nbsp; the term “military objective” in this context comes from Article 52 of Additional Protocol I to the Geneva Convention that describes military objectives as “... [T]hose objects which by their nature, location, purpose or use make an effective contribution to military action and whose total or partial destruction, capture or neutralization, in the circumstances ruling at the time, offers a definite military advantage.” Though the United States is not a signatory to the Additional Protocol I, it views this definition as an accurate restatement of customary international law. The principle of military necessity legally justifies attacks against targets that are valid military objectives because such attacks are recognized as indispensable to securing the rapid submission of the enemy. An attack upon other than a valid military objective would violate the principle of distinction, be impermissible under international law, and therefore not justifiable as a military necessity. For example, a residential home does not usually make an effective contribution to military action so is not usually a valid military target. However, a residence may become a valid military target if an adversary is using it for military purposes (such as a military command post, a fighting position, etc.). In that case, the purpose or nature of the objective has been changed by the adversary’s actions and if a definite military advantage will be achieved through targeting the residence then it may beattacked.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; </li><li>Unnecessary Suffering (Humanity). Will the use of a particular weapon for its normal or expected use cause unnecessary suffering?This principle is based in the Hague Conventions restrictions against using arms, projectiles, or materials calculated to cause suffering or injury manifestly disproportionate to the military advantage realized by the use of the weapon for legitimate military purposes. All weapons in the US inventory are permissible for use unless otherwise restricted by higher authority for operational reasons. These weapons have been reviewed to determine if they comply with the law of war and have been determined not to cause unnecessary suffering when used in the manner in which they were designed. This principle also prohibits using an otherwise lawful weapon in a manner that causes unnecessary suffering.&nbsp; An example of causing unnecessary suffering would be to modify munitions to disperse glass projectiles to complicate providing medical treatment to the wounded. The bottom line is to use the weapon/munitions as they are designed.</li><li>Proportionality. Does the military advantage to be gained from striking a target outweigh the anticipated incidental civilian loss of life and property if this target is struck? This requires the expected loss of civilian life and damage to civilian property incidental to attack not be excessive in relation to the concrete and direct military advantage anticipated from striking the target. Planners and commanders should weigh the expected military advantages to be gained from affecting a target against the incidental loss or injury to civilians and the damage or destruction of civilian property. The anticipated military advantage refers to the advantage from those actions considered as a whole, and not only from isolated or particular actions. A “military advantage” is not just a tactical gain, but can span the spectrum oftactical, operational, or strategic levels. For example, an armored vehicle used in combat is located at a school. The vehicle is a valid target. However, destroying the vehicle with certain types of munitions may place lives and safety of nearby non-combatants in jeopardy. The potential for injury to non-combatants should help guide the choice of lethal and/or nonlethal capabilities chosen against the vehicle.</li><li>Distinction (Discrimination).Have we distinguished between combatants and non-combatants; have we distinguished between military objectives and protected property or places?This principle, based on customary international law, requires parties to direct operations only against combatants and military objectives. It prohibits indiscriminate attacks which are attacks not directed at specific military objectives, those that employ a method or means of combat that cannot be directed at a specific military objective and those that employ a method or means of combat the effects of which cannot be limited.For example: Dropping munitions—guided or not—in a residential area without regard to whether there are combatants or military objectives in the area simply because there may be adversary forces there would be an indiscriminate attack. The use of gravity-guided munitions (non-precision) against enemy combatants or military objectives is not of itself an indiscriminate attack.&nbsp;</li><li>Honor (Chivalry).Is this a means of warfare or a type of conduct that would be unfair or constitute a breach of trust with the enemy?Honor demands a certain amount of fairness and mutual respect between adversaries. Parties to a conflict must accept that their right to adopt means of injuring each other is not unlimited, they must refrain from taking advantage of the adversary’s adherence to the law by falsely claiming the law’sprotections, and they must recognize that they are members of a common profession that fights not out of personal hostility but on behalf of their respective States.</li></ol>

Our commitment to staying at the forefront of these developments ensures that our clients receive up-to-date guidance and strategic advice tailored to contemporary legal challenges.<h3>The nature of war </h3>War is a violent struggle between rival parties to attain competing objectives.&nbsp; War is just one means used by nation-states, sub-national groups, or supranational groups to achieve disputed objectives.&nbsp; War has been a basic aspect of human affairs throughout history.&nbsp; The modern Western tendency to view war as an aberration in human affairs, only occasionally necessary as an operation with limited aims or an all-out campaign to destroy a clearly recognized evil, often distorts our understanding of warfare and its purposes.&nbsp; Warfare is ingrained in the very nature of certain cultures.&nbsp; While for nation states, war is an instrument of policy aiming at political objectives; it is also, even within this context, a phenomenon involving the full range of human emotions and irrationalities.&nbsp; War has a dynamic of its own, often fueled by anger, fear, revenge, and hatred.&nbsp; Thus, the resort to violence rarely remains for long tied to cold, clear political objectives; it can—and has—moved in unexpected directions.&nbsp; Military professionals operate within an environment that cannot be fully replicated in training.&nbsp; The arena in which military professionals operate is a deadly one.&nbsp; Not only are they attempting, as General George Patton stated, to “make the other poor bastard die for his country,” the enemy is attempting to do the same to us.&nbsp; Consequently, war is an arena characterized by extraordinary fear, pain, uncertainty, and suffering. Three enduring truths describe the nature of war.&nbsp; Despite technological advances and the best of plans and intentions, war will never be as straightforward in execution as planned, nor free of unintended consequences.&nbsp; The particular characteristics usually change from conflict to conflict, but the nature of war remains eternal.&nbsp;War is an instrument of policy.&nbsp; Victory in war is not measured by casualties inflicted, battles won or lost, number of tanks destroyed, or territory occupied, but by the achievement of (or failure to achieve) policy objectives or the cultural objectives of the actors involved (including nation states and non- or supra-state entities).&nbsp; More than any other factor, these objectives—one’s own and those of the enemy—shape the scope, intensity, and duration of war.&nbsp; To support US national policy objectives, military objectives and operations should be coordinated and orchestrated with nonmilitary and partner nation instruments of power.&nbsp; Prussian philosopher of war Carl von Clausewitz emphasized that war is a continuation of the policies of nations, but not all belligerents in war are organized nation states.&nbsp;War is a complex and chaotic human endeavor.&nbsp; Human impulses and human frailties shape war’s nature—it is not deterministic.&nbsp; Uncertainty and unpredictability—what many call the “fog of war”—combine with danger, physical stress, and human fallibility to produce what Clausewitz called “friction,” which makes even simple operations unexpectedly and sometimes even insurmountably difficult.&nbsp;War is a clash of opposing wills. War is collision of two or more living forces. War is not waged against an inanimate or static object, but against a living, calculating, interactively complex, and adaptive opponent.&nbsp; The enemy often does not think as we think and often holds different values, motivations, and priorities than ours.&nbsp; Victory results from creating advantages against a thinking adversary bent on creating his own advantages.&nbsp; This produces a dynamic interplay of action and reaction.&nbsp; While physical factors are crucial in war, the will of the people and the character of their leaders are also critical components of war.&nbsp; Allied and enemy resolve—the determination to force one’s will on one side and to resist on the other—can be the decisive element.Success in war requires mastery of the art of war as well as the science of war. Warfare is one of the most complex of human activities.&nbsp; Success depends more on intellectual superiority, morale, and determination than it does on numerical and technological superiority.&nbsp; Success thus demands an intricate combination of science (that which can be measured, studied, and controlled) and art (creativity, flexibility, intuition, and the ability to adapt).&nbsp;&nbsp; Sound doctrine, good leadership, effective organization, moral values, and realistic training can lessen the effects of uncertainty, unpredictability, and unreliability that are always present in war.The classification of situations of armed violence is fraught with difficulties. Some governments deny that they are involved in armed conflicts, arguing that they are engaged in counter-terrorism operations not governed by international humanitarian law. Others apply international humanitarian law to situations that do not amount to an armed conflict under international humanitarian law. Moreover, contemporary armed conflicts are increasingly complex due to the multitude of state and non-state parties involved.&nbsp;While there are many definitions of armed conflicts used for different purposes, the question whether or not a situation of armed violence amounts to an armed conflict as understood in international humanitarian law, has important consequences. Most importantly, states involved in armed conflicts will have rights and duties that do not exist outside armed conflicts as understood under international humanitarian law: international humanitarian law only applies in situations of armed conflict. Below the threshold of an armed conflict, states must respect international human rights law, which is more restrictive than international humanitarian law, in particular in respect of the use of force and detention of individuals. All parties to a conflict, including, non-state armed groups, are bound by international humanitarian law. In contrast, there are on-going discussions to what extent and under which circumstances international human rights law is applicable to non-state armed actors. Moreover, war crimes may only be committed in connection with an armed conflict, the law of neutrality may be triggered, and arms control treaties may be affected.Similarly, the distinction between international and non-international armed conflict matters for various reasons. First, there is no generic category of armed conflict under international humanitarian law, but two discrete categories, i.e. international and non-international armed conflicts. The two categories are based on different definitions and different criteria to assess whether or not a given situation amounts to an international or non-international armed conflict. Second, there remain important differences in the regimes governing international and non-international armed conflicts. Most notably, combatant immunity or the formal status of civilian only exists during international armed conflicts. From the perspective of enforcement, the regime governing grave breaches of the Geneva Conventions is limited to international armed conflicts.By providing an independent and impartial assessment based on open source information, ILW strives to promote a more coherent approach to classification of conflicts, and, ultimately, to foster implementation of the applicable legal framework, which is a key element for accountability and the protection of victims.

Our last publication:<h3>Genocides at a glance!</h3>This book offers a comprehensive examination of genocides throughout history, focusing particularly on the legal responses, frameworks, and efforts to prosecute those responsible for these horrific crimes. It highlights the evolution of international law and the challenges in holding perpetrators accountable. Beginning with a historical overview of major genocides, the book introduces readers to the complex interplay between political, social, and legal forces that enable genocides to occur. Each chapter analyzes specific genocides and looks at how they were executed, their long-term consequences for the affected populations, and the global response at the time. Key events, such as the systematic extermination of the Armenians in 1915, the Holocaust during World War II, and the Rwandan Genocide in 1994, are explored with respect to the scale, methodology, and scope of each atrocity. A significant portion of the book addresses the legal dimensions of genocide. It critically examines how international law has evolved over time, from the early efforts to prosecute war crimes after World War I to the formation of the United Nations Genocide Convention in 1948, and the creation of international criminal tribunals. The book explores the role of Raphael Lemkin, the jurist who coined the term "genocide" and who lobbied tirelessly for the establishment of an international framework to prevent and punish genocide. The Study delves into the legal mechanisms used to address genocide, such as the work of the International Criminal Court (ICC), International Criminal Tribunal for Rwanda (ICTR), International Criminal Tribunal for the former Yugoslavia (ICTY), and hybrid tribunals such as the Special Court for Sierra Leone (SCSL). These tribunals are analyzed not only as legal institutions but also in terms of their effectiveness and limitations in delivering justice to victims. The book also provides in-depth discussions on the difficulties of defining and prosecuting genocide in the context of evolving legal standards. The legal criteria for genocide-especially the intent to destroy a national, ethnical, racial, or religious group-are scrutinized, as well as the challenges of gathering evidence and ensuring fair trials.
